How the firm assists

Jurisdiction and forum strategy

We assess the parties, contractual forum clauses, applicable law, location of assets and existing proceedings to plan the Pakistan component of a cross-border dispute. Provide the agreements, party details and a chronology before taking steps that may affect a jurisdiction objection.

Parallel proceedings and coordinated defence

We coordinate pleadings, evidence and procedural positions where related proceedings run in Pakistan and overseas. A shared timetable and complete copies of filings help counsel identify inconsistent positions, overlapping relief and urgent response dates.

Anti-suit and anti-anti-suit relief

We assess whether seeking, opposing or responding to anti-suit or anti-anti-suit relief is legally available and appropriate in the particular forum. Review begins with the relevant orders, jurisdiction clauses, proceedings and evidence of prejudice; no particular injunction or outcome is assumed.

Interim protection and enforcement restraints

We evaluate urgent protective measures and responses to threatened enforcement, including the legal basis for any proposed restraint. Send sealed orders, service records, undertakings and deadlines immediately so that compliance and challenge options can be assessed.

Foreign judgments and Pakistan assets

We assess the recognition or enforcement of foreign judgments in Pakistan and potential objections, including jurisdiction, procedural fairness and the applicable statutory route. Certified judgments, satisfaction records and reliable asset information are central to the review.

Foreign counsel, evidence and settlement

We coordinate with appropriately qualified overseas counsel on service, evidence, expert input and settlement terms across jurisdictions. Instructions should identify the relevant countries, authorised decision-makers and existing advisers; foreign-law advice and appearances remain with qualified counsel.

Governing framework

The legal framework depends on the dispute, forum and relief sought. Pakistan proceedings may engage the Code of Civil Procedure, 1908, applicable substantive law, contractual jurisdiction provisions and rules of evidence. Foreign-judgment questions include the requirements of sections 13 and 44A of the Code where applicable. Foreign arbitral awards are assessed under their separate statutory framework.

Anti-suit and related relief requires a forum-specific review of jurisdiction, available powers, existing orders and the effect on proceedings elsewhere. Overseas procedural requirements must be checked with local counsel.

Likely stages

  1. Identify countries, parties, proceedings, orders and immediate deadlines.
  2. Review contracts, jurisdiction, governing law and available remedies.
  3. Coordinate with overseas counsel and agree a consistent litigation strategy.
  4. Prepare Pakistan pleadings, evidence and any appropriate urgent applications.
  5. Manage hearings, parallel developments and settlement opportunities.
  6. Assess recognition, enforcement, compliance and any appeal options.

Documents commonly required

  • Complete agreements, including jurisdiction and arbitration clauses
  • Pleadings, applications, judgments and interim orders from every forum
  • Evidence of service, hearing dates and procedural deadlines
  • Chronology, correspondence and prior undertakings
  • Relevant ownership, corporate and asset records
  • Foreign counsel’s contact details and translations where needed

Frequently asked questions

Can a Pakistan court automatically stop overseas proceedings?

No automatic result should be assumed. Any proposed relief requires assessment of the court’s jurisdiction, the legal basis, the parties and the existing proceedings. The effect of an order in another country requires advice in that jurisdiction.

What should I do if an overseas order has already been served?

Send the complete order, associated papers, service details and all deadlines promptly. Do not assume that a challenge suspends compliance obligations; the options must be reviewed with counsel in the relevant jurisdictions.

Can every foreign judgment be executed directly in Pakistan?

No. The route depends on the originating court and territory, the nature of the judgment and the applicable legal requirements. Foreign court judgments and arbitral awards require separate analysis.

Does the firm conduct proceedings in foreign courts?

The firm advises on Pakistan law and coordinates cross-border strategy with appropriately qualified foreign counsel. Overseas appearances and local-law advice are arranged through counsel authorised in the relevant jurisdiction.
